Refusal to Investigate

The Election Commissioner must refuse to investigate a complaint if there is insufficient evidence to meet the “reasonable grounds” threshold or if the complaint is not within the Election Commissioner’s legal jurisdiction.

The Election Commissioner may refuse to investigate a complaint if the Election Commissioner is of the opinion the substance of the allegations set out in the complaint are frivolous or vexatious.

If a complaint received from the public does not result in an investigation, we inform the complainant(s) of this fact, in writing, and the reasons behind such decisions.
