Recall TPAs

Amendments to the Election Finances and Contributions Disclosure Act (EFCDA) are in force effective March 31, 2022. In addition, the Citizen Initiative Act and the Recall Act have come into force effective April 7, 2022. Information on this website has been updated to reflect the changes.

A Recall Third Party Advertiser engages in advertising to promote or oppose the recall of an MLA whose electoral division is the subject of the recall petition.

Any eligible person, corporation, trade union or group that engages in recall advertising is required to register with Elections Alberta when it has incurred or plans to incur expenses of at least $1,000 for recall advertising, or it has accepted or plans to accept at least $1,000 in recall advertising contributions.

There are currently no registered Recall TPAs.


Deregistered Recall TPAs

There are currently no deregistered Recall TPAs.


Contributions

A registered Recall TPA can only accept recall advertising contributions from individuals ordinarily resident in Alberta and within the electoral division, corporations that do business in Alberta and in within the electoral division, Alberta trade unions, and groups with members made up of any of the aforementioned individuals and entities. Contributions can be money or in-kind donations of goods or services.

The maximum a Recall TPA can receive from any given contributor is $4,000 per contributor, less any contributions the contributor may make to other authorized participants during a petition canvassing period. In the case of a recall vote, another $4,000 per contributor can be contributed to authorized participants during the recall vote period.

The TPA chief financial officer is responsible for reporting contributions to Elections Alberta and issuing official contribution receipts to contributors. Receipts issued for contributions to TPAs cannot be claimed for income tax credits.

Fundraising Events

A registered Recall TPA or anyone acting on their behalf can hold events and activities to raise funds for recall advertising. Examples of fundraising events include a luncheon, meet & greet, rally, golf tournament, silent auction etc. Contribution rules limit who can pay to attend or who can donate/bid at a silent auction. All fundraising revenues and expenses must be reported on the TPA’s advertising return.

Expense Limits

A registered Recall TPA can spend a maximum of $3,000 on advertising expenses during a recall petition period plus another $3,000 during a recall vote period, if applicable. Recall advertising expenses are any expense incurred for the production of a recall advertising message in the format in which the message is to be transmitted and the acquisition of the means of transmission to the public of a recall advertising message.

Filing Deadlines

For a recall petition, Recall TPAs must disclose their financial activities to Elections Alberta by filing weekly contribution reports during the recall canvassing period (recall advertising period). In addition, an advertising return consisting of a financial statement, contribution report, expense report, and supporting information and documentation must be filed within 4 months after the recall petition period. Audited financial statements must be filed within 6 months after the period if advertising expenses exceed the limit.
